You Need a Will A Last Will and Testament, often referred to simply as a will, is a written legal declaration itemizing how a person wants his or her affairs handled after death. The Will can make dispositions of property, set up trusts, and establish guardians upon a person’s death. Under Texas law, a Will must identify the person making the Will or “Testator,” be written with “testamentary intent,” and be executed with requisite testamentary formalities. State law also requires that the Testator have “testamentary capacity,” including being of sound mind. A Will can be straightforward and simple or very complex depending on the estate and what the Testator wants to accomplish. If you are interested in a Will, it is best to contact an attorney and to have the Will drafted and executed properly to make sure that the Will complies with Texas probate law.
