Family law is a specialized area of civil litigation that encompasses more legal issues than simply obtaining a divorce. People refer to a “divorce” because that is the word used to define the end of the legal relationship created when you got married. However, a divorce case always requires the resolution of other legal issues such as child custody, child support, spousal support, visitation, and property division.
When life does not go as you planned, it is very important that you seek the advice and counsel of a knowledgeable and experienced lawyer. The right attorney will give you practical legal advice that you can use to get through the legal difficulties with which you are presented. At the Nelson Law Group, PC, we listen to you and then provide a straightforward evaluation of your case.
Personal Injury law is a specialized area of civil litigation that includes a party who has been injured as a result of another parties’ negligence. The most common cases arise out of automobile accidents but many arise from injuries that occur on property owned by someone else or in any other setting where another party’s actions injure someone else. The party causing the injury can be an individual, a group of individuals or a business/corporation. The party who brings the lawsuit is referred to as the Plaintiff and the person sued is the Defendant.
Civil Litigation is the broad category of cases that involve disputes between two or more parties that arise because a party believes they have experienced some form of injustice or have been injured as a result of the other parties’ negligence. These cases are often referred to as:
Breach of Contract – one party breaks a promise to another
Commercial Litigation – disputes between businesses
Personal Injury – person injured by another party’s negligence.
The party who brings the lawsuit is referred to as the Plaintiff and the person sued is the Defendant.
Estate Planning – Contemplating a day when you are no longer around to enjoy your family, pursue your dreams, and relax with the people you love most can be painful. For some people, this thought is so painful that they neglect estate planning altogether. While no one likes to think about a time when they are no longer around, careful estate planning is one of the most important things you can do for your family. At The Nelson Law Group, we help you plan while contemplating and protecting your family’s needs.
You Need a Will
A Last Will and Testament, often referred to simply as a will, is a written legal declaration itemizing how a person wants his or her affairs handled after death. The Will can make dispositions of property, set up trusts, and establish guardians upon a person’s death. Under Texas law, a Will must identify the person making the Will or “Testator,” be written with “testamentary intent,” and be executed with requisite testamentary formalities. State law also requires that the Testator have “testamentary capacity,” including being of sound mind.
A Will can be straightforward and simple or very complex depending on the estate and what the Testator wants to accomplish. If you are interested in a Will, it is best to contact an attorney and to have the Will drafted and executed properly to make sure that the Will complies with Texas probate law. If your Will is declared invalid after your death, substantial legal costs, delays, and unnecessary tax liability may be incurred, and your property may be awarded to someone other than who you wanted to have it.
At the Nelson Law Group, PC, we will guide you through the process and help you make thoughtful, informed decisions in drafting your will.
