What, then, is the purpose of the Polo Ralph Lauren Outlet Store and its purported 30% discount? This appears to constitute a deceptive and misleading pricing practice intended to cause customers to believe they are receiving a 30% discount when, in fact, they are paying the equivalent of the regular full price. This type of representation creates false urgency, draws customers into the store under the pretense of substantial savings, and induces purchases based on a discount that appears illusory rather than genuine. As a matter of federal law, advertising is unlawful if it is false or misleading in a material respect. The FTC states that advertising must be truthful and not misleading, and that deceptive pricing practices fall within its consumer-protection authority. The FTC’s pricing guidance specifically addresses misleading “former price” and comparison-price claims. Under Texas law, false, misleading, or deceptive acts or practices in the conduct of trade or commerce are unlawful under the Deceptive Trade Practices Act (“DTPA”), Tex. Bus. & Com. Code § 17.46.
