The cashier Melanie R. tried to promote its physical “membership card” saying that I can get 5% extra off on everything. I was curious thought I have a membership account with Nordstrom Rack yet. Then I confirmed with her, “Is that like an upgraded physical membership card?” She firmly said yes. Then I said, “Sure, why not.” Until I handed my ID upon her request and she handed a brochure to me, I noticed the there is two small words “ credit card” printed on the cover. I asked her so this is a credit card, not a membership card. She then reluctantly said yes. I got pretty angry and pointed out that was a misrepresentation, inducing clients to consent to get a “membership” card but actually a credit card. She reneged that she didn’t misrepresent. Lying and denying dumb wrongdoing in front of a lawyer is not funny at all! If that’s the way how Nordstrom trains their employees. Then no surprise misrepresentation and frauds are so common here. At least the standard format of the term and condition brochures print out the material fact, “It’s credit card.” Imaging today is a senior who can’t see things clear and faces such situation, Nordstrom is the superior respondent and bear the vicarious liability. I suggest you’d better discipline the employee. Otherwise, it makes Nordstrom no different than a lawless unlicensed business.
