FORMAL NOTICE OF CONSUMER FRAUD AND VIOLATION OF FEDERAL AND STATE LAWS.
On March 21st, I visited this store to purchase a phone. I was extremely clear with the employee, Karla: I explicitly told her that I did NOT authorize a credit pull and that I only wanted to use Progressive Leasing. She looked me in the eyes and falsely assured me that would be the case, deceptively processing a Citibank credit card application without my consent.
Upon noticing the unauthorized hard inquiry on my credit report, I returned to the store the following day to resolve this in good faith. When confronted, her response was that "it was the only way to process the transaction." If she knew it couldn't be done separately, she had a legal obligation to inform me it wasn't possible, and I simply would have walked away. Instead, she chose to lie and deceive me to meet sales quotas at the expense of my credit history.
This conduct constitutes a direct violation of the following laws:
1. STATE LAWS (Texas Business and Commerce Code - DTPA):
• Section 17.46(a): Prohibits false, misleading, or deceptive acts or practices in the conduct of any trade or commerce.
• Section 17.46(b)(12): Specifically prohibits representing that an agreement involves rights, remedies, or obligations which it does not have (such as claiming a credit pull was mandatory).
• Section 17.46(b)(24): Failing to disclose information with the intent to induce a consumer into a transaction they would not have entered had the information been disclosed.
2. FEDERAL LAWS:
• Fair Credit Reporting Act (FCRA) - 15 U.S.C. § 1681b: Obtaining a credit report under "false pretenses" and without a "permissible purpose" (lack of consumer consent).
• Dodd-Frank Act (UDAAP): Prohibits Unfair, Deceptive, or Abusive Acts or Practices by financial service providers.
The subsequent treatment from Karla was arrogant and disrespectful, with absolute indifference from local management who refused to correct the fraud committed by their employee. Notice to other customers: Do not stay silent. File your complaints with the Office of the Texas Attorney General (Consumer Protection Division) and the Consumer Financial Protection Bureau (CFPB).

I’ve been shopping here for quite some time. I have to share my most recent experience though. Good customer service is hard to find. Yet in this store every single Employee was so courteous happy to be there and happy to help me. The store was completely refreshing and I made sure to let the manager know on my way out. I love that they didn’t try to upsell me. They just shared facts and information and let me make the ultimate decision.

Picked up a stove today. Did not come with a power cord, which I paid for and don’t understand why they charge for that. Plus, you can’t contact the store directly. The system patches you to an overseas 3rd party call center! Seriously! ? So I have to drive back to the store to communicate and get the parts… Unbelievable… Also, Lowe’s and Home Depot have the same problem… smh…
More importantly, my frustration is when I went back, the representative told me that it’s sold separately (as if like you didn’t know).. In that case, why would the guy sell me the range without the cord??? Ohhh, because him and two coworkers were chatting on the phone in the appliance department while I needed service! Just another reason why I don’t deal with Best Buy anymore… I immediately cancelled my membership that I just started because I thought things would change…. At least the manager cared and apologized…
