Birth Injuries Of all the injuries that can occur as a result of medical malpractice, perhaps none is more tragic than harm to a newborn baby. Delivery rooms are intended to be safe places where a mother can bring her child into the world with the help of trained doctors, nurses, and specialists. Unfortunately, delivery room doctors and obstetric staff don’t always maintain the standard of care that babies and their mothers deserve. Birth injury can occur as a result of: Failure to monitor mom and baby Failure to detect fetal distress, preeclampsia, and other complicating conditions Failure to administer Pitocin safely Failure to perform a timely cesarean section Failure to use obstetric maneuvers, vacuum extraction, or forceps properly to ease baby out of the birth canal Staff members in the delivery room are trained to make informed, split-second decisions to protect both patients. Unfortunately, the wrong split-second decision can lead to a lifetime of hardship for the affected child, with complications including: Cerebral palsy Shoulder dystocia Erb’s palsy Lack of oxygen resulting in brain injury Broken bones, most commonly the collarbone, humerus, or femur baby in hospital The worst-case scenario for any birth injury is the death of a child. Insurance carriers have a duty to policyholders. When you buy an insurance policy, the insurer agrees to provide you with a specified amount of coverage for your home, vehicle, or well-being (to name a few prominent examples) in exchange for timely payments of your premiums. Bad faith occurs when the insurance company breaches its duty to you, the policyholder. In Oklahoma, simple negligence doesn’t necessarily constitute bad faith. Instead, your attorney must make the case that the insurer breached its duty of negotiating with you in good faith. Examples of bad faith and unfair dealing include: Denying a reasonable claim without adequate cause Underpaying a legitimate claim Failure to investigate claims Failure to provide a basis for denial in writing Failure to provide payment for a claim in a reasonable timeframe The insurance claims process is complicated. Large insurance companies have sizable legal teams who represent the interests of their employer, not the policyholders. The workers’ compensation system is designed to aid workers who get hurt or fall ill while working within the scope of their employment. It is a type of insurance held by employers to compensate employees when they suffer work-related injuries. The Oklahoma Workers’ Compensation Commission (OWCC) presides over benefits for injured workers. injured worker metal steps Unlike personal injury cases, workers' comp is a no-fault system; neither you nor your employer is liable for the injuries you sustain. Read more about Workers' Comp Claims in our Blog » What to Do after a Workplace Injury in Oklahoma Preserving the integrity of your claim begins the moment you get hurt. Workers' comp claims are subject to very strict rules and deadlines that you must follow in order to receive the full benefits you deserve. When you get hurt at work, here are the steps you must take: Report the injury to your employer: Notify your employer ASAP that you’ve been hurt. Some employers maintain tight deadlines for reporting an accident, and failure to follow internal protocols could result in the company disputing your benefits claim. Complete an incident report as soon as you can. Seek medical attention: When you report a work injury, you need to kindly demand to see a medical professional. Get the care you need from this specified provider only. Going to a doctor of your own choosing could result in denial of your workers’ compensation claim. Give the doctor a good history: The appointment with the doctor is your opportunity to get the type and extent of your injury on record. Tell the doctor all about your symptoms, limitations you’re facing, and actions that exacerbate the injury. A comprehensive medical record that documents your injury is one of the best assets in a workers’ comp claim. When you follow these steps, you enhance the strength of your claim for benefits. Your employer also has responsibilities at this time.
