Cannabis Law

Legal sales of cannabis and related products in the United States totaled nearly $7 billion in 2016, and future sales are forecasted to be more than $30 billion by 2021 and $50 billion by 2026. The trajectory of the emerging legal cannabis industry in New Jersey has created innumerable potential opportunities for entrepreneurs and businesses. However, the industry is subject to unique complexities, including the conflict between Federal and state cannabis laws, the intricacies of cannabis laws passed by the individual states, and the rights and obligations of businesses that interface with legal cannabis industry members. The Cannabis Law practice group at Scarinci Hollenbeck, LLC assists clients in understanding current and potential medical and adult-use cannabis laws and legislation. To accomplish these objectives our attorneys draw upon expertise in more than a dozen practice areas, including: Cannabis Law and Policy, Environmental & Land Use, Licensing and Franchising, Commercial Real Estate, Litigation, Corporate Transactions and Business, Insurance Recovery and Liability, Public Law, Crisis and Risk Management, Intellectual Property, Tax, Trust & Estates, Cyber Security and Data Protection, Labor and Employment, and Zoning.

Bob Levy has been my lawyer for thirty-five years. He has handled cases that include opposition to a petition for zoning variance, malpractice on the parts of an architect and contractor, complications from an automobile accident, wrongful harassment from a collection agency, and details pertaining to administration of an estate. When special expertise was needed, he either got it from within Scarinci Hollenbeck, or he found it for me using his extensive list of contacts. I would not think of making a change. He is my lawyer for so long as he wants to be.

I cannot recommend Sean Peña highly enough. I came to Sean during an extremely stressful and uncertain time after deciding to change attorneys because I no longer felt confident that my previous representation was the right fit for my case. Making that change was difficult, but after Sean was recommended to me by a friend, choosing him turned out to be one of the best decisions I could have made. From the beginning, Sean was direct, transparent, professional, and focused on the facts. He never made unrealistic promises or told me simply what I wanted to hear. Instead, he clearly explained the law, the strengths and realities of my case, the possible outcomes, and what I could expect at each stage of the process. His knowledge, preparation, and confidence were evident throughout my representation. What stood out most was the confidence I felt having Sean beside me in court. This was an incredibly stressful and intimidating experience, but I knew I had an attorney who understood the law, was fully prepared, and was willing to advocate strongly on my behalf. He is straightforward, ethical, easy to communicate with, and takes his responsibility to his clients seriously. Sean proved to be a man of his word and an attorney I could genuinely trust. I am extremely grateful that I chose him to represent me, and I would not hesitate to retain him again if I ever needed legal representation in the future. I would confidently recommend Sean Peña to anyone seeking an experienced, knowledgeable, and highly capable attorney. Having him represent me made an enormous difference during one of the most stressful situations I have faced.

There are moments in life when you need more than just a good attorney—you need someone you can trust to stand beside you when everything feels uncertain. That's exactly who Sean Pena was for me. My case was incredibly complex, and at times, it was emotionally overwhelming. There were days when I questioned how everything would turn out, but Sean never did. He stayed focused, determined, and always had a plan. No matter what obstacles came our way, he never lost sight of the goal, and that gave me the confidence to keep going. What makes Sean different is that he genuinely cares. He listened, he understood what was at stake for me, and he fought for the outcome I deserved as if it were his own case. His knowledge of the law is exceptional, but it's his ability to combine that expertise with unwavering dedication and compassion that truly sets him apart. Because of Sean's hard work and commitment, we won my case. I'll never be able to fully express how grateful I am for everything he did and the weight he helped lift off my shoulders. If you're in New Jersey and looking for an attorney who is not only brilliant at what he does but also someone who will genuinely fight for you every step of the way, I can't recommend Sean Pena enough. He is one of a kind, and I will always be thankful that he was the one in my corner.
