They say that a public defender doesn't get the job done. Well, Rex Roldan did with my case. A friend who I believed loved and cared about me for many years stabbed me in the back and then filed harassment charges against me in Washington Twp, N.J. She then went on to fabricate lies about me to the court which is a serious situation. Fortunately I had much proof in black and white that we had a long standing friendship stemming from the animal rescue work we were involved in for over 10 years. She told the court we were never friends. This not only broke my heart but interrupted my entire life for almost a year. I live in Asheville and via virtual technology I was allowed to fight for my life and the truth. Had a number of hearings. The judge knew I was a good person and the clerk's were extremely helpful during this whole ordeal. Atty Roldan truly went all the way and the outcome was wonderful in the end. I am extremely grateful for his services and devotion to prove the truth for in the end that's what counts. Whatever goes around surely comes around and I believe the Universe has done its job as well. I am not judge and jury. Thank you atty Roldan for all your effort and belief in me. Blessings Sent. Frequently Asked Questions About Law Offices Of Rex J. Roldan PC

What is a Chapter 7 bankruptcy case?

Chapter 7 bankruptcy, often referred to as a 'fresh start' bankruptcy, is designed for individuals and married couples primarily burdened with unsecured debts such as credit card bills, medical expenses, and unpaid utility bills. This legal process typically concludes within three to four months. During this time, debtors are not required to make payments to creditors. The case concludes when the bankruptcy court grants a discharge, which releases debtors from personal liability for most debts and prohibits creditors from pursuing collection actions. Generally, debtors can retain personal belongings valued below certain 'exemption' thresholds. If debtors maintain payments on secured debts like mortgages and car loans, they can usually keep these assets. Eligibility for Chapter 7 depends on factors including income level, home equity, and the timing of any previous bankruptcy discharges. For more detailed information, it's advisable to consult with experienced bankruptcy attorneys.

What is a Chapter 13 bankruptcy case?

Chapter 13 bankruptcy is typically suitable for individuals who either don't meet the qualifications for Chapter 7 or require specific protections not available under Chapter 7. In a Chapter 13 case, the debtor proposes a repayment plan spanning three to five years. Monthly payments are made to a trustee, who then distributes these funds to creditors. Any remaining debt after the completion of the plan is discharged. This type of bankruptcy can be particularly beneficial for those facing home foreclosure or vehicle repossession due to payment defaults. It allows debtors to propose a plan to catch up on overdue payments, potentially becoming current on mortgages or car loans by the plan's conclusion. Consulting with qualified bankruptcy attorneys can provide more comprehensive guidance on filing for Chapter 13.
