What is the price to update a Will?
It depends on the complexity of your plan, and whether you need or want a Will or Revocable Living Trust (RLT) as your primary estate planning document. We have a list of standard fees for various packages of documents, but the final fee for any given client depends on exactly what documents that client decides to have us prepare and how the plan contained in those documents is structured, and we don't know that until we have had an estate planning consultation with the client so that we can learn enough about the client's wishes, assets, and family situation to help them develop a plan that best suits them.
What is Probate?
Probate is the process by which a deceased person’s Will is formally recognized as valid by the applicable Probate Court. The Probate Courts themselves advise people to retain the services of a good probate lawyer whenever they delve into estate matters. The best way to be certain that the wishes of the deceased will be carried out to the letter, and that beneficiaries will receive what is due them in a timely manner and without excessive taxation, is to engage the services of a qualified Atlanta probate law firm.
How do I sell an estate property that has a lien?
As the Executor of the estate, you can negotiate for the sale of the property held by the estate. If the property has a home equity line on it, the balance due on that loan will need to be paid off, either before the sale or as part of it. It's something a real estate closing attorney should be able to help with- it's no different than selling any other property that has a loan on it, except that you'll be selling as the Executor of an estate instead of as the individual property owner.

What you need to know to determine where a person’s Will should be offered for probate is where their principal residence was located at the time of death or, in more technical terms: Where they were domiciled? The answer to this question is not always easy, but basically, you look at things like: Where were they registered to vote? Where was their driver's license issued (and where were any other licenses they may have held issued)? Where was their job, if they had one? Where did they most often stay? Where was their vehicle registered? Where were their memberships in such groups as a house of religious worship, social clubs, or professional groups? What address did they use to file income taxes?
