Can a spouse or partner drop domestic violence charges?
Though alleged victims cannot automatically withdraw domestic violence charges, a withdrawal or attempted withdrawal are still sometimes possible. There are several factors to consider, such as whether the prosecutor and legal parties wish to consider allowing a withdrawal.
If the alleged victim does wish to withdraw the charges, it can strongly help the accused’s case. However, once charges of domestic violence, false imprisonment, stalking, sexual battery/rape, assault or battery are filed, the case is largely out of your hands and the hands of the alleged victim.
What is the difference between assault, battery, and domestic violence in Florida?
Chapter 784.011 of the Florida Statutes defines assault as “an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in other person that such violence is imminent.” Note there need be no actual physical act of violence committed for an act to be defined as assault, merely the threat to do violence.
Chapter 784.03 of the Florida Statutes defines battery as when an individual “actually and intentionally touches or strikes another person against the will of the other; or intentionally causes bodily harm to another person.”
Aggravated assault or aggravated battery may be charged if the acts of violence are particularly severe. These are both felony charges.
Domestic violence assault or domestic violence battery may be charged if the acts of violence were committed by one family or household member against another. When these charges are labeled as domestic violence, they come with longer terms of incarceration and probation, among other increased penalties upon conviction.
What is the difference between drug possession and "constructive" possession of drug charges in Florida?
Actual possession of drugs is when the police find the drugs on you, in your hand, and no one else had equal access to the drugs found.
Constructive possession of drugs occurs when law enforcement believes there are multiple people with knowledge and access to drugs. This might be the case if you are in a car that is stopped by police and a search reveals drugs in the glove compartment. You could also face constructive possession charges if you are at a friend’s house while police execute a search warrant and find drugs.
What are the penalties for a DUI in Florida?
If convicted of drunk driving, penalties may vary depending upon a number of different factors, including the blood alcohol level of the driver, if a minor was in the vehicle, whether the driver was involved in a crash, and most importantly, whether the driver has any prior DUI convictions. Any or all of this information will affect the potential penalties that a driver may face.
What are the penalties for a first DUI offense in Florida?
The following are examples of some penalties you might face for your first DUI conviction. Please note that every case is different and the penalties will vary based on the facts of your individual case.
- Up to a 12-month driver’s license suspension
- Up to six months in county jail, 12 months in jail if there was any property damage.
- Fines and court fees of up to $1,000

What are the penalties for a second or more DUI conviction in Florida?
Penalties will increase dramatically for a second conviction within five years or third conviction within 10 years and a fourth conviction. A second conviction within five years of your first carries with it a mandatory 10 days in jail and a maximum of nine months in jail; there is also a five-year suspension of your driver’s license. A third conviction may actually be charged as a felony, punishable by up to five years in state prison and a 10-year driver’s license suspension.
For a fourth DUI conviction there is the possibility of five years in state prison and a lifetime driver’s license suspension with no possibility for a hardship license ever. This means you can never legally drive again in Florida.
What crimes have mandatory sex offender registration in Florida?
Even if the sexual act was consensual or the offense was minor, sex offender registration is often mandated. The registries distinguish levels of severity involving sex crimes, but inclusion on that list will limit residence, work and travel opportunities.
