I am a U.S. Citizen and my fiance is a foreign national, can I bring my fiance to the United States?
There are two processes that can be done to help bring your fiance to the United States. First, you can sponsor your fiance for a Fiance(e) Visa Petition allowing on approval your fiance to come to the United States to begin the process of her permanent residency. This process requires a marriage within 90 days of arrival to the United States. Alternatively, you can marry your fiance in their country or a third country and file a spousal petition. Once I obtain a Green Card, what do I need in order to obtain citizenship through naturalization?
Eligibility depends upon a number of factors, including criminal and immigration history and proficiency in the English language (with a few exceptions). Generally, a person will have had to be a lawful permanent resident for 5 years in order to apply (or 3 years based upon marriage to a U.S. Citizen). In cases in which an undocumented immigrant is facing deportation, there exist several different ways that one can "defend" themselves or protect themselves from being removed from the United States or "deported." Each case presents different facts and factors that need to be analyzed by an attorney to determine what is the best defense strategy to prolong the time in the United States and or obtain a green card within the Immigration Court system.
My family member has been arrested and is in an immigration detention center, what can I do?
Immigration detention is a civil form of confinement. Depending mostly on criminal history, it is very possible to be released from immigration custody. This requires petitioning an Immigration Judge for a custody redetermination hearing.
