Frequently Asked Questions About North Country Chiropractic
Are carriers required to have their communications plan and routing contact phone number in place during the phase-in period after 1/1/05 but before they file the MCS-150B?
Carriers are not obligated to adhere to permitting requirements before submitting their Hazardous Materials Safety Permit application during the phase-in period. However, FMCSA advises companies to establish these systems prior to applying for their HM Safety Permit. This ensures the systems are operational and compliant once the permit is issued.
Are CDL drivers who are employed by state government agencies subject to DOT drug and alcohol testing requirements?
Yes, drivers employed by government agencies who operate vehicles requiring a CDL are subject to DOT drug and alcohol testing, unless specifically exempted in 382.103(d). The definition of 'employer' in Part 382 includes government entities, and 382.103(c) clarifies that exceptions for government agencies in certain Federal Motor Carrier Safety Regulations do not apply to FMCSA drug and alcohol testing requirements in Part 382.
Are CMV Drivers required to be CPR certified?
There is no regulatory requirement for commercial motor vehicle drivers to obtain CPR certification.
Are CMV drivers who operate in interstate commerce required to have a medical certificate?
DOT Medical Certificates are mandatory for drivers operating in interstate commerce under specific conditions. These include vehicles with a GVWR, GCWR, GVW, or GCW of 10,001 pounds or more, vehicles designed to transport more than 15 passengers, vehicles carrying 9-15 passengers for direct compensation, or vehicles transporting hazardous materials requiring placards. However, operators of covered farm vehicles, as defined in 390.5, are exempt from this requirement.
Are government employees exempt from routine/yearly physical examinations?
Transportation conducted by federal, state, or local government entities, or agencies established under interstate compacts approved by Congress, may be exempt from the Federal Motor Carrier Safety Regulations, including routine physical examinations, if the political entity chooses to exercise this exemption.
Are motor carriers legally obligated to provide air conditioning in commercial motor vehicles?
The Federal Motor Carrier Safety Regulations do not contain any provisions regarding the requirement for air conditioning in commercial motor vehicles.
