Protect your employees, and yourself from claimants. In Florida, video surveillance without audio is generally legal in public areas of a restaurant, but audio recording or live audio monitoring requires the consent of all parties involved. Under Florida Statute § 934.03 (The Security of Communications Act), Florida operates as a strict all-party consent state. Deploying remote surveillance platforms like RemoteVu, or using enhanced audio equipment (such as directional microphones) to record or listen into conversations without explicit permission, can result in a third-degree felony charge and significant civil liabilities. Expectation of Privacy: While open dining rooms have a lower expectation of privacy than a restroom or a private office, Florida courts strictly protect face-to-face verbal communications from high-tech eavesdropping or enhanced remote interception. Employee Monitoring: Recording employees' audio in kitchens, break rooms, or behind the bar without their documented consent is heavily restricted.
