  I experienced what I believe was deceptive and unprofessional conduct regarding the handling of a negotiable instrument. The representative misrepresented her authority and failed to properly review or verify the instrument before refusing consideration. Under banking regulations, UCC commercial law, and general contract principles, financial institutions are expected to act in good faith and follow reasonable commercial procedures when handling negotiable instruments. Instead of conducting a fair evaluation, the matter was dismissed without proper procedural review. I am documenting the incident and preserving records for further investigation into potential deceptive business practices and violations of fair banking standards. Branch manager please be advised this is the definition of what I am explaining towards you In the consideration, 1. Misrepresentation of a material fact Someone states something false or misleading that matters to the transaction. 2. Knowledge of falsity (scienter) The person either knows it is false or acts with reckless disregard for the truth. 3. Intent to deceive The purpose is to induce another party to rely on the false statement. 4. Justifiable reliance The other party reasonably relies on the false statement. 5. Resulting damages Harm or loss occurs because of that reliance.
