    On Friday morning, August 14, 2026, we contacted Fogel HVAC after discovering that our air conditioning was not operating. The power had gone out across the area around 5:40 p.m. the previous evening and was restored by the next morning. We performed basic troubleshooting, but the HVAC system still would not turn on. We then spoke with neighbors who were experiencing similar HVAC problems, and one of them provided Fogel’s emergency-line number. During our call, Fogel’s representative told us that if the company determined the issue was related to an “act of nature,” we would be responsible for the diagnostic fee, parts, and labor because the warranty would not apply. Fogel sent a technician to our neighbors’ home that same day. Their technician diagnosed a failed circuit board and confirmed that their repair was covered under warranty. Although we live right next door and called only minutes after our neighbors, Fogel was unable to service our home that Friday, even though it was still before 5 p.m. Our family spent the night in an 85F home while running multiple fans. We were told that a technician would visit the next day, but Fogel could not provide an estimated arrival time. We waited all day Saturday in an 93F house and were not notified that the technician was on the way until approximately 5:12 p.m. He arrived around 6 p.m. The technician diagnosed a malfunctioning circuit board, which was the same apparent issue identified at our neighbors’ home. He also mentioned a Freon leak, although no actual leak was found. He then stated that Fogel considered the issue related to the prior power outage and that we would be responsible for the diagnostic fee, parts, and labor. To be clear, we are not stating that the storm or power outage caused the HVAC failure. We are stating that the system was not operating after power had been restored, and Fogel attributed the failure to an “act of nature” without providing us with a clear explanation or documentation showing how that determination was made. Our newly built home was purchased only five months ago, on April 15, 2026. We questioned why the same apparent circuit-board problem was covered under warranty for our next-door neighbors but denied coverage for us. We also questioned why surge protection was not installed on a brand-new system in an area that regularly experiences severe weather. While the technician was at our home, I called Fogel’s office to request an explanation for the different warranty treatment. The representative was unable to provide a clear answer and said she would need to speak with her supervisor. I explained that I would be awaiting a response and that, if we could not reach a fair resolution, I might consult an attorney to review the warranty and the legality of the company’s position. After I mentioned consulting an attorney, the representative said she could no longer discuss the matter with me, stated that it would be escalated to management, told me to have a good day, and ended the call. The technician also told me that they were actually giving us a deal because the price of the part was being reduced to $275 instead of the full price. I did not consider that an acceptable resolution. I should not be expected to feel grateful for paying to replace a component on a brand new system, especially when a neighboring customer with the same apparent problem received full warranty coverage. I refused to pay because I disputed the warranty determination and felt the situation was handled unfairly and inconsistently. Fogel should apply its warranty policies consistently, provide clear written explanations when denying coverage, and improve its emergency-service communication and response times. Homeowners should carefully review their HVAC warranties, ask how exclusions are determined, and request written documentation before authorizing diagnostic fees or repairs.

    Nicholas was a consummate professional during his visit to our home. He went above and beyond to ensure what could have been a 2-visit job was completed in his single visit. He took the extra time to explain to us everything that he was doing, ensure that we understood and even left us with some prevention tips. We can't predict a lightning strike, but we definitely know who to call if it happens again.

    Charlie was a very hard worker while fixing our AC, especially in our hot house! He had to climb into our attic several times, even though we don’t have attic stairs, and he never complained. He was efficient, kind, and professional, and he took the time to explain everything he was doing. We truly appreciated his hard work and dedication.
