    Ashton Woods refused to return our earnest money after concerns were raised regarding foundation crack in garage floor per home inspection. This was requested after just one week under contract. After the defect was realized in the inspection, we provided timely notification to Ashton Woods in hopes that they would return earnest money, address the defect and be able to market the house without delay. Instead, Ashton Woods emailed us a letter from a professional engineer saying that an unnamed member of their team (with no known credentials) conducted a visual assessment and concluded that there were no apparent foundation issues at this time. We were told that any future issue would be covered by their 6-year warranty. We raised concern that even a repaired foundation was a real defect that would have to be disclosed in a future real estate transaction and negatively impact the home’s value. Either way, we did not want to take on the risk. Our concerns were disregarded. Up until this point we had been considering building the same floor plan in another neighborhood. But when they treated us so poorly, there was no way we would consider building with them! While seeking to enforce the contract with us and not return our earnest money, they also began marketing the home for sale on the MLS. Only after our realtor raised ethical concerns about their breach of contract while we are still trying to negotiate the return of earnest money did they send us a contract release which stated that we could use the earnest money towards another home with them if closed inside of one year. We refused to sign this. Then they sent a letter stating that if we did not respond within 48 hours in writing then the contract was being considered nullified and they would have the right to market the property, which they were already doing. We replied within 48 hours restating that we still had a contract with them and demanded the return of our earnest money. We heard nothing and the home went under contract within the week. The home closed approximately five weeks later and was removed from the MLS. The fact that they refused to return the earnest money and then marketed the property while still under contract with us was a complete breach. Honestly, if this is how they treat customers with concerns, I am so glad we did not buy a house from them. I have no idea how or why Ashton Woods has a decent reputation in the industry. They lost a potential customer in us and I would caution anyone considering purchasing a home from them. Be very certain the home has no issues BEFORE going under contract, because they will not negotiate at all. The contract stipulates all disputes (even with the contract) must go to construction industry arbitration. This means buyers essentially have no recourse through civil courts should anything not go as planned. They got you over a barrel. Completely unfair business practices. They should be ashamed of themselves. Hope the few thousand dollars you stole from us was worth it!

    You can't do anything in this community without a complaint. It almost feels like you can't even breath. I was more comfortable at our rental than at our brand new house. Beautiful house, not worth living here at all. Think twice before buying here. Thank me later.
