Potential Clients Beware: TD Bank lacks proper account safeguards!
I write to provide formal notice of a series of unauthorized electronic fund transfers from my TD Bank accounts and to demand full reimbursement pursuant to the Electronic Fund Transfer Act (“EFTA”), 15 U.S.C. § 1693 et seq., and its implementing regulation, Regulation E, 12 C.F.R. Part 1005.
This matter did not arise from a single isolated incident. Rather, it reflects a pattern of fraud that began in August and culminated in unauthorized electronic debits from my accounts, despite my repeated good-faith efforts to safeguard my funds and rely on TD Bank’s representations and systems.
I. Initial Act of Fraud – August
In August, I was first targeted by an individual impersonating TD Bank. The caller used a spoofed TD Bank 800 number and possessed detailed, confidential information about my accounts, including information that would not have been available to an ordinary third party.
The caller’s knowledge, tone, and apparent access to internal banking information reasonably led me to believe that I was communicating with TD Bank itself. During this initial contact, the imposter created a sense of urgency and conveyed that my accounts were at risk, inducing me to take steps that I believed were necessary to protect my funds.
Although I acted in good faith and with the belief that I was following TD Bank’s instructions, this interaction marked the first act of fraud in a continuing scheme designed to misappropriate my funds.
II. Escalation and Unauthorized Transfers
Following this initial August incident, the fraudulent activity escalated. The imposter continued to masquerade as TD Bank, again using spoofed telephone numbers and leveraging confidential account information to reinforce the deception.
As a direct result of this impersonation and fraud, electronic transfers were effectuated out of my accounts by a person other than myself, without my actual authority, and from which I received no benefit. At no point did I knowingly authorize these transfers, initiate them, or consent to the movement of funds for the benefit of any third party.
III. These Transfers Were “Unauthorized Electronic Fund Transfers” Under EFTA / Regulation E
The Electronic Fund Transfer Act and Regulation E govern electronic debits from consumer accounts, including online- and telephone-initiated transfers. Regulation E defines an “unauthorized electronic fund transfer” as a transfer from a consumer’s account initiated by a person other than the consumer, without actual authority, and from which the consumer receives no benefit.
The official commentary further clarifies that an unauthorized electronic fund transfer includes one initiated by a person who obtained the access device or account information through fraud.
That is precisely what occurred here. An imposter, masquerading as TD Bank and armed with detailed confidential information, induced me—through deception and misrepresentation—to take steps that enabled him to effectuate transfers from my accounts. I did not authorize these transfers, nor did I receive any benefit from them. Accordingly, the debits from my accounts qualify as unauthorized electronic fund transfers under EFTA and Regulation E.
IV. TD Bank’s Statutory Obligations
Once TD Bank received notice of these unauthorized electronic fund transfers, federal law required the Bank to conduct a prompt, good-faith investigation. Where such an investigation cannot be completed within the statutory timeframe, Regulation E requires provisional credit and, ultimately, reimbursement for unauthorized transfers.
Any attempt to deny reimbursement on the theory that I was “tricked,” “manipulated,” or “socially engineered” is contrary to Regulation E and its official commentary. The law is explicit that transfers initiated through fraud, impersonation, or deception are unauthorized, even where a consumer was induced to take certain steps in reliance on false representations.

Bank manager Rena Barkouras and internal finance officer Dana Maultsby ran my credit twice within a month, initially approving a $25,000 business line of credit for my corporation. After weeks of delays, shifting explanations, and excessive nitpicking, the approval was reversed into a $10,000 counteroffer and ultimately reduced to a final decision of $0 after New Year’s. The process lacked transparency, consistency, and honesty, and unnecessarily involved the SBA as a guarantor. Over a month of my time was wasted. I will be contacting headquarters and cutting all ties with this bank. Avoid this branch.
