I closed with City Abstract/First American on Friday, May 10, 2024, as a buyer. The water meter at the property was missing, so the title company escrowed money from the seller to cover the meter installation and any outstanding water bill to be paid by the seller.
The new water meter was installed in June, and I sent the bill to City Abstract/First American on July 17, 2024. They did not pay immediately. I reached out again on September 18, 2024, since it was still unpaid. Shortly after, I received a letter from the Department of Revenue stating, "A lien will be filed against your property unless you take action now." I contacted City Abstract/First American again on September 29, 2024, as I was traveling from September 18 to September 29 and received the warning letter on September 29. I didn't receive a response until October 2, 2024, when they stated, "The checks were sent out last week. The liens are removed when the payment is applied." Why did they delay payment after my initial contact on July 17 and again on September 18?
As a result of City Abstract/First American's tardy responses and actions, a lien was placed on my property. Although it was eventually removed once their payment was processed, I am now facing a lien fee. I reached out again on October 17 to request they cover the fee, as the lien should not have been filed had they paid promptly when I first contacted them in July. Not only did they take several days to respond, but they are now refusing to cover the fee, claiming it was placed after the closing date. Yes, it was filed after closing because they waited months to process the payment.
As of October 31, 2024, they are still refusing to take responsibility.
